Booking
Once your reservation is made with us the booking form must be completed by a member of the party who must be 25 years or older, and who shall then be deemed as the agent for all persons shown on the form. All information will be sent to the agent who must advise the rest of the party of any information. Once we receive the booking form, we have a binding contract. The procedures and conditions will still apply even if for any reason the booking form has not been completed by the client, e.g., in the case of a late booking which necessitates immediate commitment. The accommodation cannot be shared, assigned or sublet and only the persons shown on the booking form are permitted to stay in the property. Under no circumstances is the property to be used as a venue for group parties.
Villa Occupancy
The maximum capacity is 12 persons and must not exceed this number in order to comply with state fire regulations. Persons/children under the age of 18 years are not accepted unless accompanied by parents or an adult. All occupants must be named on the Booking Contract and, if this number changes, you must inform us prior to arrival.
Damage
Any loss or damage must be reported to the management company immediately and the party leader is responsible for any loss or damage. We reserve the right to withhold money from the security deposit to pay for any loss or damage caused by any member of the party. You agree to permit reasonable access to the management company to carry out any necessary repairs and maintenance.
Smoking Policy
Smoking is strictly forbidden in area inside the house. Smoking is permitted on the decking area and ashtrays are provided. If it is deemed smoking has taken place inside the house you may be subject it a professional cleaning fee to omit tobacco odor.
Pets
No pets are allowed in or around the house. Registered service animals are accepted in accordance with Florida Statutes. Please ensure that we are informed if you intend bringing a registered service animal and provide us with registration details at the time of booking. If a pet is found to be in the house, no matter for how short a time, then you will be charged for a thorough deep clean of the entire property including carpets and comforters and for any damage that the pet may have done whilst in the property, deck and/or garden areas.
Check-in/Check-out
Our home is available for occupation from 4.00 p.m. (local time) on the day of arrival until 10.00 a.m. (local time) on the day of departure. However, whenever possible, we will arrange late check-out or early check-in. Unfortunately this often cannot be confirmed until a few days before your arrival and a few days before your departure. Vacating after 10.00am without prior arrangements may incur charges equivalent to one day's accommodation cost.
Payment
You are required to pay us a non-refundable deposit per booking. The outstanding balance is due two months prior to the date of your arrival. If you are booking is less than two months prior to occupancy the balance must be paid in full. Failure to comply with the payment procedure will be deemed to be a cancellation by the guest and will be subject to cancellation charges. We reserve the right to cancel any bookings if the guest fails to pay the balance by the due date.
Cancellation Charges
More than 8 weeks prior to arrival: Loss of deposit only
4-8 weeks prior to arrival: Loss of 50% of the rental cost
Less than 4 weeks prior to arrival: Loss of total rental cost
The booking deposit is non-refundable. Your insurance company will cover you for most cancellation reasons beyond your control and we strongly advise guests to take out adequate insurance as soon as their vacation is booked.
Security Deposit
We require a refundable security deposit of $450 for (but not limited to) breakages, loss or damage to property or excess utility bills during your stay. You must leave the villa in the condition you found it and you are also liable for any loss or damage in excess of the security deposit. Signing of the Booking Contract means you agree to pay the full cost of all damages and excess bills up to and beyond the security deposit. The security deposit is payable prior to your arrival and can either be included in the final payment and will be returned to you by check following your departure. However, we have found the easiest and quickest method is via credit card direct from our website. You pay the deposit which then will be refunded, normally within 48 hours of your departure. There are no credit card charges to you for using this method and it also enables us to refund your deposit almost immediately without having to wait for postal services and bank clearances. This method must be paid at least three days prior to your arrival.
Swimming Pool & Hot Tub
Due to the nature of the prevailing weather systems in the sub-tropical climate of Florida, we cannot guarantee the water temperature in the swimming pool. The pool is heated to the temperatures required by Florida state law and is set to operate at set standard hours during the day - this ensures that guests paying for heating service get the optimum benefit and that we comply with the operating requirements of the system as laid down by the manufactures. The actual water temperature will vary with the ambient temperature, time of use and prevailing weather conditions.
All children must be supervised at all times and caution must be taken around wet areas. We the owners and the management company do not accept any responsibility or liability for any injury or death caused as a result of use of the pool, the hot tub or pool area. Guests are expressly forbidden to allow children to use the pool or hot tub without supervision. There is a safety fence separating the pool from the house which is secured prior to your arrival - guests with children MUST ensure the fence is securely fastened at all times. For extra safety the doors leading to the pool are also fitted with alarms. The owners or management company accept no responsibility for injury or death caused by using the hot tub. It is advised that children under the age of 12 are not to use the hot tub - the heat can cause blood pressure and heart rates to rise. The same applies to any adults with high blood pressure or heart problems.
For safety reasons, glass must not be used around the pool area - plastic ware has been supplied to avoid this.
Unless prearranged the pool heating will be switched off and any attempt to tamper with any mechanism or otherwise use utilities not paid for will constitute as theft. Any breach of this condition will result in forfeiture of the security deposit (but not limited to).
Florida is subject to summer lightening storms - it can be extremely dangerous to be in the pool or hot tub during these storms so please ensure all guests are out of the water when a lightening storms occur.
Security Alarm System
The house is protected by a monitored security system which not only acts as a burglar deterrent but is also a monitored fire alarm. It is a condition of booking that all guests activate the alarm whenever the house is unoccupied.
Force Majeure
We cannot be held responsible nor accept any liability where we are prevented from fulfilling our contractual obligations by 'force majeure'. These include but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes and other industrial disputes, natural disaster, fire, acts of God, terrorist activities, technical difficulties with transportation and utilities, closure of airports, ports or ferries, quarantine, epidemics, weather conditions, government action or other events outside our control. Your travel insurance may cover you in some of these events.
Service Failure
We cannot be held responsible for the failure of public services, such as electricity or water and failure of mechanical equipment such as air-conditioning, washing machines, dishwashers although we would make every reasonable effort to remedy such failure. We will address any equipment failures immediately but cannot enter into any discussions regarding refunds for any equipment failure.
Services Provided
We have provided a wide range of services free of charge such as internet access, cable television, phone calls etc. and, if anything is unavailable or unworkable we will do everything possible to rectify the situation. However, we will not enter into discussions of any form of refund for any equipment at all that fails unless it is something you have specifically paid for in advance.
Description
Whilst all information supplied in the brochure and web site is deemed to be correct and to the best of our knowledge, it is understood that the information supplied is for guidance purposes only, could change from time to time, and does not form part of any contract.
Limitation of Liability
Although every effort is made to ensure that the home is in perfect condition, and as described in the literature supplied, it is a condition of acceptance of the Terms & Conditions that the Guest understands this information is as supplied at the time of writing and is subject to change without notice. We cannot accept responsibility for third party claims, accidents, damage to, or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of howsoever they may have occurred. All equipment and utilities supplied within the home are done so with the express understanding that the guests are solely responsible for any use of such equipment. Guests are welcome to use any and all equipment supplied in and around the house but do so at their own risk.
Telephone Calls
Calls made from the house are paid for by us. However, to protect ourselves from misuse we unfortunately must set a limit. Calls to UK landlines: 400 minutes per week. Calls to UK mobiles: 25 minutes per week. Calls to US and Canadian landlines: 400 minutes per week. Calls to US cell phones 100 minutes per week. Calls to European landlines: 200 minutes per week. Calls to European mobiles: 20 minutes per week. Calls to UK 0800 and premium rate numbers 20 minutes per week. We have online facilities and can monitor daily activity. If we feel guests have abused this service we will deduct the additional costs from the security deposit.
Insects
Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The house is treated regularly as part of a professional pest control program. Keep all windows and external doors closed whenever possible; not only will this help to keep bugs from the property, but it will also enable the air-conditioning unit to function more efficiently. If any bugs are found within the home, please inform us immediately.
Guest Responsibilities
It is the responsibility of each and every guest to read and understand the guest services book, and to ensure that all rules are adhered to. The party leader is responsible for the actions of all the guests in their party. Failure to abide by any of these rules could result in deductions being applied to your security deposit. The villa will be professionally cleaned prior to guests arrival and again after the guests' departure but it remains the responsibility of the guest to ensure the villa is left in an orderly state. Kitchen utensils & BBQ's (grill and drip tray) should be cleaned before leaving. The management company will charge for any extra cleaning and this will be deducted from the Guest's Security Deposit.
Travel Documents
All passport, visa, travel insurance and health certificates are your responsibility and we accept no responsibility for delay or expense incurred through loss or irregularities in your documents. Cancellation caused by guests due to incorrect documentation will be charged the relevant cancellation fees.
Complaints
In the unlikely event of complaints, you must inform either the management company or us immediately and everything within our power will be done to resolve any problems to your satisfaction.
General Conditions
Liability. We cannot accept liability for acts or omissions over which we have no control. This includes (but is not limited to) airlines, car hire companies, management companies and for loss or damage caused by Force Majeure events such as strikes, fire, flood, delays or any other events beyond our control.
Instructions and deposits taken and confirmed by telephone/verbally/email are binding and will be subject to the same terms and conditions as written confirmations.
Refunds will not be made for services included in the holiday price that are unused after the departure date.
All guests will be responsible for behaving in a responsible manner and in accordance with local regulations. We do not accept any responsibility for termination of travel or holiday arrangements due to guests causing distress, annoyance, damage or danger to others and therefore will not consider any claims for compensation.
The accommodation cannot be shared or sublet and all persons must be shown on the booking form.
Clients are strongly advised to take out holiday travel insurance.
Game Room/Garage
A games room has been provided as an extra service to our guests. However, this has replaced the garage and therefore in door parking is not available. There is parking space for two vehicles on the driveway. All drinks and food must be kept away from the gaming tables and any damage, such as spillages on the pool or hockey table will be deducted from the security deposit. If the security deposit does not cover the damage the excess must be paid immediately.
NO RESPONSIBILITY ATTACHES ITSELF TO THE OWNERS IN RESPECT OF ANY INJURY, ACCIDENT OR DAMAGE CAUSED WHEN CLIENTS USE THE POOL AND ANCILLARY EQUIPMENT. IT IS THE RESPONSIBILITY OF THE PARTY LEADER WHO SIGNED THE BOOKING FORM TO ENSURE A SAFE ENVIRONMENT EXISTS AT ALL TIMES IN AND AROUND THE PROPERTY AND, IN PARTICULAR, THE SWIMMING POOL AREA
IT IS STRONGLY RECOMMENDED THAT ALL GUESTS HAVE PROPER AND ADEQUATE TRAVEL INSURANCE. WE WOULD ALSO ADVISE TAKING OUT INSURANCE AS SOON AS YOUR VACATION IS BOOKED TO COVER YOU FOR ANY UNFORSEEN CIRCUMSTANCES WHICH MAY RESULT IN YOU HAVING TO CANCEL YOUR VACATION. |
